Florida: HM 381 Puts Constitution At Risk
We need your help. HM 381 is a bill to call for a Constitutional Convention of the States (Con Con). Please Contact the Florida House Judiciary Committee and tell them to vote NO on HM 381. Your call is extremely important. When Representatives get just 10 calls they think that everybody is against it.
MESSAGE: Vote NO on HM 381. HM 381 calls for a Constitutional Convention of the States for the purpose of proposing amendments. According to former Chief Justice Warren Burger a Convention cannot be limited and puts our U.S. Constitution at risk because radicals and special interest groups will have their own agenda at a Convention. Florida gets 32.08% of its state budget from the Federal Government. Are Florida Legislators ready to give up one-third of their state budget in order to balance the Federal Budget? If Florida really wants the federal government to balance the federal budget then Florida Legislators should refuse federal mandates and send back all federal money coming into Florida.
Are you as a Legislator willing to refuse the federal money and mandates?Unless you are, an application for a Constitutional Convention for a balanced federal budget or to limit the federal government’s spending, is a sham. (or write your own message-more info below).

EMAIL the Committee:
Article V of the U.S. Constitution states: “The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress…” Notice that Congress Calls the Convention and will set the rules…not the States.
Question: Why do we think that the Congress that ignores the Constitution now would be any more likely to abide by a new amendment to the Constitution?
Florida gets one-third, some 32.08%, of its state budget from the Federal Government. Are Florida’s Legislators ready to give up one-third of their state budget in order to Balance the Federal Budget? State Legislators, Republican or Democrat, will not vote to reject federal funds and mandates.
This website lists the percentages of state budgets coming from the Federal Government. Highest Mississippi: 45.35% to Alaska 19.97%. This is why a Balanced Budget Amendment won’t work. Legislators, Republicans or Democrats will not vote to cut their own budgets to balance the federal budget.
A Convention cannot be Limited: Former Chief Justice Warren Burger stated: “I have also repeatedly given my opinion that there is no effective way to limit or muzzle the actions of a Constitutional Convention. The Convention could make its own rules and set its own agenda. Congress might try to limit the Convention to one amendment or to one issue, but there is no way to assure that the Convention would obey. After a Convention is convened, it will be too late to stop the convention if we don’t like its agenda…”
There are many radical groups like www.movetoamend.com that support an Article V Constitutional Convention of the States and have their agendas ready. Move to Amend wants to take away our free speech and only allow the government to fund candidates.
