Phyllis discussed this very question on the August 11 program with Dr. Kevin Gutzman, the author of The Politically Incorrect Guide to the Constitution. Dr. Gutzman is an Associate Professor of American History at West Connecticut State University who received his Ph.D. at the University of Virginia and his J.D. from the University of Texas Law School.
Dr. Gutzman explained that there are two types of Constitutional law. Starting in the 20th century, law schools taught only the case method--in other words, what judicial opinions said. The guest prefers to teach what the framers of the Constitution intended. He believes judges should make decisions based on what the document actually says.
Dr. Gutzman explained that the system was originally designed so that states could decide complicated issues such as abortion. The Tenth Amendment declares that the national government only has powers delegated to it by the state governments, but the Supreme and federal courts have disregarded this very important part of the Constitution.
The guest continued that Congress has several ways to reign in this judiciary, including impeaching judges for using their power politically. Congress has ceded not only many of its domestic powers to the judiciary, but also its foreign powers to the presidency. Regaining these powers would establish more of a balance among the three branches.
